Terms of Service & User Agreement

1. Acceptance of Terms & Governing Jurisdiction

By accessing or using the CondoPoint platform (www.condopoint.ca), associated web applications, or real estate services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you must discontinue using the Service immediately.

This Agreement shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal dispute or proceeding arising out of or relating to your use of CondoPoint shall be submitted exclusively to the courts located in Toronto, Ontario, Canada.

2. MLS® System & TRREB Listing Data Terms

Real estate property data displayed on CondoPoint is provided under licensing agreements from real estate boards, including the Toronto Regional Real Estate Board (TRREB), the Canadian Real Estate Association (CREA), and participating Ontario Multiple Listing Services® (MLS®).

Personal & Non-Commercial Use: You acknowledge that all real estate listing information, property images, market statistics, sold history, and floor plans displayed are provided solely for your personal, non-commercial use to evaluate prospective condo purchases, sales, or leases.

Strict Prohibition Against Scraping: You are strictly prohibited from copying, harvesting, scraping, crawling, redistributing, re-transmitting, or indexing any MLS® listing content, photographs, or data from this website using automated software, bots, or manual extraction methods.

The trademarks REALTOR®, REALTORS®, and the REALTOR® logo are controlled by CREA and identify real estate professionals who are members of CREA. The trademarks MLS®, Multiple Listing Service®, and associated logos identify quality services provided by member boards.

3. Ontario Real Estate Agency & TRESA Disclosures

In accordance with the Trust in Real Estate Services Act, 2020 (TRESA) regulated by the Real Estate Council of Ontario (RECO):

No Implicit Representation: Browsing property listings or submitting inquiries through CondoPoint does not automatically create a client or representation relationship between you and CondoPoint or any participating licensed real estate brokerage/broker.

A formal client-broker relationship is established only upon reviewing the RECO Information Guide and executing a written Representation Agreement (such as a Buyer Representation Agreement or Seller Representation Agreement) as mandated by Ontario real estate regulations.

4. User Accounts & VOW Membership

Access to certain advanced Virtual Office Website (VOW) features—such as saved condo favorites, email alerts for new listings, and detailed historical sold price data—requires account creation and verification.

By creating an account, you confirm that you have a bona fide interest in purchasing, selling, or leasing real estate in Ontario. You agree to provide accurate registration details and maintain the security of your credentials.

CondoPoint reserves the right to suspend or terminate accounts that breach these terms or exhibit suspicious automated activity.

5. Accuracy Disclaimer & Financial Calculators

All listing prices, maintenance fees, property tax amounts, square footage estimates, and historical statistics are obtained from third-party MLS® feeds and seller representations believed to be reliable but are not guaranteed.

Calculators & Valuation Tools: Outputs from CondoPoint calculators (including Land Transfer Tax, Mortgage Payment Estimators, and Home Evaluation Estimates) are mathematical approximations provided for general illustration purposes only.

Nothing on CondoPoint constitutes formal legal, mortgage, appraisal, or financial advice. Users should independently verify property details and consult licensed real estate salespersons, mortgage brokers, and real estate lawyers prior to executing real estate contracts.

6. Limitation of Liability

To the fullest extent permitted by applicable Canadian law, CondoPoint, its directors, officers, employees, and real estate partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your reliance on site content, MLS® data, or service interruptions.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

7. Amendments & Contact Information

CondoPoint reserves the right to update these Terms of Service at any time. Continued use of the platform following any modifications constitutes acceptance of the revised terms.
